TERMS AND CONDITIONS

These terms and conditions (the “Terms and Conditions”) govern the use of

www.cmwt.com.au (the “Site”). This Site is owned and operated by Classic Muscle Weddings and

Tours (CMWT). This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and

agree to always abide by them.

CMWT will provide a copy of these terms and conditions with every booking.

 

Intellectual Property

All content published and made available on our Site is the property of CMWT and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

 

Sale of Services

These Terms and Conditions govern the sale of services available on our Site.

The following services are available on our Site:

– Charter/Chauffeur Services, tours.

In most cases, the services will be paid for with an initial ‘Save the date’ payment and a final ‘balance’ invoice due two weeks prior to the booking. If the booking is close to or inside two weeks ahead, the total balance is due in full on receipt of the invoice.

These Terms and Conditions apply to all the services that are displayed on our Site at the time you

access it. All information, descriptions, or images that we provide about our services are as accurate

as possible. However, we are not legally bound by such information, descriptions, or images as we

cannot guarantee the availability of all services we provide. You agree to purchase services from us

at your own risk.

We reserve the right to modify, reject or cancel your order if it becomes necessary. If we

cancel your order and have already processed your payment, we will give you a refund equal to the

amount you paid. You agree that it is your responsibility to monitor your payment instrument to

verify receipt of any refund.

 

Payments

We accept the following payment methods on our Site:

– Credit Card.

– Bank Deposit; and

– Cash.

When you provide us with your payment information, you authorise our use of and access to the

payment instrument you have chosen to use. By providing us with your payment information, you

authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the

right to cancel or reverse your transaction.

 

Refunds

Refunds for Services

We provide refunds for services sold on our Site as follows:

– A full refund will be given if the service is cancelled due to a breakdown or unavailability.

– No refund will be given if the service is cancelled by the client within 48 hours of the service booking, however, a credit may be issued for up one year, for the value of the service booked at the discretion of CMWT.

A full refund of the ‘balance’ invoice will be issued for cancellations with more than 48 hours’ notice.

 

Hirer’s Responsibility

Charter of CMWT’s cars can only be made by an adult 18 years of age or over.

We are happy for students to inquire and hold a limousine for a school ball, but the hire agreement must be authorised by a parent.

The hiring customers will be held responsible for the conduct of all passengers within their party.

 

Alcohol

CMWT reserves the right to terminate the charter agreement without a refund if passengers become unruly or abusive. CMWT are happy for guests to enjoy their own music, drink alcohol and expect that you will have fun in the cars, but we will not tolerate excessive intoxication or abusive or antisocial behaviour from a group.

All school ball limo hire must be alcohol free.

 

Smoking

All vehicles are non-smoking by law. Should this condition be ignored the drivers are instructed to terminate the charter agreement immediately.

 

Seat Belts

All passengers are required to wear seat belts in accordance with current laws (where fitted).

Children under the age of four can only be transported in CMWT’s classic cars with an accompanying parent to ensure they are safe in the car as child restraint devices are not fitted. Parents should consider booster seats if needed and these are their responsibility.

Carriage of children aged four to seven in limousines using correct seat belts and booster seats when required is permitted.

 

Final confirmation and booking adjustments

CMWT sends out a confirmation email on confirmation of your booking including a link to a questionnaire which helps us plan your itinerary, a reminder will be sent if this form is not completed initially.

Changes to booking schedules (or even hire date) are acceptable subject to the availability of the vehicle during the new times when different to the original booking. Changes must be confirmed by email to ensure your booking is adjusted.

Bookings are confirmed by phone during the week before the booking. CMWT staff will attempt to call and/or email during the week prior to booking. If you do not receive the call, please telephone the office to confirm your booking.

CMWT does not charge for adjustments to a booking unless the total hire time increases, or you upgrade to a more expensive or additional vehicle. If your hire time or the number of vehicles needed decreases, we will adjust the booking amount to accommodate this if the change is outside 48 hours’ notice.

 

Overtime Rates

CMWT chauffeurs will attempt to inform customers when they are approaching the end of the scheduled hire. In most cases, the driver can remain for extra time when requested. The hire rate charged for overruns on hire time are $60 per half hour or part thereof. Overtime will be invoiced to the hiring customer and deducted from the credit card when applicable. Drivers may have commitments after your booking, so we recommend that you build some time into your schedule for unexpected delays on the day.

Having said that, we are a flexible business and will not charge overtime rates if a final drop-off is 10 -15 minutes after the booked finish time, unless it has been previously noted that we need to leave on time.

CMWT will never knowingly double book your time and will honour your wedding booking until the agreed finish time.

 

Damage or Soiling

We accept a reasonable amount of clean-up as part of our service, however, if excessive mess (including upholstery damage, spillage and soiling) will be charged a commercial cleaning fee to the hiring customer. The cleaning and sanitising fee for soiling is approximately $300, damage at cost. Repair costs will be invoiced.

 

Unforeseen Event Affecting the Hire Vehicle

In the event of an unforeseen accident or breakdown before or during the event or wedding hire, we reserve the right to substitute an alternative vehicle for those booked. This is provided as a service to the hiring customer. CMWT will always attempt to provide a suitable alternative, so you are not further inconvenienced on the day.

Although we do our best to provide an alternative with a possible breakdown, accident or flat tyre we cannot guarantee this, or a timely turnaround (especially when the hire extends outside the central Perth service area).

In the event of an unforeseen accident or breakdown or other circumstance which may affect the schedule during a wedding or charter booking, CMWT will not be held liable for compensation beyond the cost of the car hire for the specific vehicle and time it is not in service.

If a hold-up during a hire is due to circumstances outside our control (traffic congestion, severe weather, emergency etc) CMWT will not be held liable for any refund.

 

Limitation of Liability

CMWT and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

 

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or

any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these

Terms and Conditions will not limit your legal rights and remedies under that legislation. These

Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is

a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the

legislation will apply.

 

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Classic Muscle

Tours and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions,

claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our business

Site or your violation of these Terms and Conditions.

 

Applicable Law

These Terms and Conditions are governed by the laws of the State of Western Australia.

 

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be

inconsistent or invalid under applicable laws, those provisions will be deemed void and will be

removed from these Terms and Conditions. All other provisions will not be affected by the removal

and the rest of these Terms and Conditions will still be considered valid.

 

Changes

These Terms and Conditions may be amended from time to time to maintain compliance

with the law and to reflect any changes to the way we operate our Site and the way we expect users

to behave on our Site. We will notify users by email of changes to these Terms and Conditions or

post a notice on our Site.
